If an Ogre player uses Grut's Sickle to cast Transformation of Kadon does he ignore the penalty from the magic item as it is now non-functional? Same question for other items with Penalties I guess.

As I keep saying, most rules discussions are superfluous, if one applies the simple principle: unless specifically stated otherwise, normal rules apply. And from your previous posts, I should think you can be more confident in your own judgement.
That said: it is a question of sequencing. If the penalty happens before the Transformation is cast, it applies; if after [edit: successfully!], it does not. In the case of Grut's Sickle the initial penalty happens before the spell is cast (indeed it is the precondition to get the bonus for casting spells), hence it applies. However, the subsequent penalty (at the end of the Magic phase) does not apply.

Thanks, I like to see if anyone can see an error in what seems to be a simple order of operations or know of an FAQ that would cover the scenario. Granted I expect the minute you try it somebody is going to object to it =P
Its a niche trick to begin with, I guess its hard to lynch a Hydra.
